Legal information and purpose of these General Terms and Conditions of Sale

These General Terms and Conditions of Sale of the company Ecomeo OÜ (hereinafter "General Terms and Conditions of Sale") - whose full contact details are available in the General Terms and Conditions of Use, accessible from the footer of the website (hereinafter "Barazol") - are intended to define the rights and obligations of Barazol and the Customer (as designated below) in connection with the sale of Products from the website Barazol.com (hereinafter the “Site”) published and operated by Barazol.

The terms of use of the Site and the free services accessible from it are defined in the General Terms of Use of Barazol, available in the footer of the site.

The terms of use for the paid services accessible from the Site are defined in the General Terms of Service of Barazol, accessible from the footer of the site.

Barazol customer service can be reached by email at contact@barazol.com.

Barazol reserves the right to modify these General Terms and Conditions of Sale at any time. Any new version will be communicated to the Customer before the Order is finalized. Customers who do not wish their Order to be governed by the new General Terms and Conditions of Sale should refrain from placing an Order on the Website.

The applicable General Terms and Conditions of Sale are those published on the Website at the time of the Order. These apply to all products sold on the Website.

Definitions

The following terms, whether used in the singular or plural in these General Terms and Conditions of Sale, shall have the following definitions:

  • Client: refers to any natural person aged 18 years or older, contracting with Barazol to acquire Products for their personal needs;
  • General Terms and Conditions of Sale: refers to these General Terms and Conditions of Sale;
  • Privacy policies: refers to the privacy and personal data protection policy for Customers implemented by Barazol and accessible from the website footer, which forms an integral part of these General Terms and Conditions of Sale;
  • Order: refers to the order(s) for Product(s) placed by the Customer with Barazol on the Site and according to the terms and conditions set out in these General Terms and Conditions of Sale;
  • Personal Data: refers to the personal data of the Customer collected and processed by Barazol in connection with the Order, under the conditions and terms defined in the Privacy Policies;
  • Withdrawal form: refers to the form, in Appendix 2 of these General Terms and Conditions of Sale, allowing the implementation of the right of withdrawal of the Order by the Customer;
  • Products: refers to the products sold by Barazol from the Site;
  • Site: refers to the website published by the company Ecomeo OÜ, accessible in particular via the URL address Barazol.com
  • Barazol: refers to the company Ecomeo OÜ, whose registered office is located at Lõõtsa tn 2a, 11415 Tallinn, Estonia, registered under number 16563515.

Product Overview

Barazol offers the Customer the opportunity to purchase Product(s) of their choice offered on the Site.

Prior to placing an order, the Customer can view the characteristics of the Product(s) they wish to order directly on the Site.

Terms and Conditions of the Order

Geographic Area

Orders can only be delivered within the European Union and the United Kingdom. Orders not meeting these geographical limitations will not be processed.

Order Validity Conditions

Orders placed on the Site may only be for personal use, as declared and acknowledged by the Customer. In this regard, Barazol reserves the right to limit the number of Orders placed if an excessive number suggests commercial use of the Products.

These restrictions may apply to Orders placed using the same credit card, or using the same billing and/or shipping address.

The Customer is prohibited from reselling Barazol Products, reserving the right to prohibit sales to any Customer who resells Products.

Ordering Process

To place an Order, the Customer must visit the Site, purchase the Product(s) of their choice by clicking on the "Add to Cart" button and specifying the number of Products desired.

From the "Shopping Cart" page of the Site, the Customer enters their delivery and billing address and expressly accepts the terms of these General Terms and Conditions of Sale by checking the corresponding box, then proceeds to pay the amount of the Order by credit card.

The order placed by the customer will only be final upon actual payment of the order amount by the customer.

Order Confirmation by Barazol

Every Order placed by a Customer on the Site is subject to immediate written confirmation from Barazol, sent by email to the Customer.

An email is also sent to the Customer to inform them of the shipment of the purchased Product(s).

Product Availability

Barazol undertakes to deliver the Products within the limits of available stock.

If one of the Products is unavailable, the Customer will be informed:

  • either, when placing the order on the Site, the sale cannot be completed;
  • either, after payment of the price, by email, as soon as possible. Barazol will refund the price of the unavailable Product(s) to the bank account used for the Order, within thirty (30) days of notification sent to the Customer.

Price and regulations

The prices displayed on the Site for each Product are indicated in euros, including all taxes.

Payment is made exclusively by bank card (CB, Visa, MasterCard) on the Site.

Payments via PayPal, American Express or other payment methods will not be accepted.

Payment is made on the Site through a secure banking platform, which is managed by a third-party company. In this context, Barazol does not have access to the Customer's payment information at any time and cannot be held liable in the event of fraudulent use of the payment methods used.

Delivery

Delivery methods

Each Product delivery is deemed to have been made upon the package being made available to the Customer.

Without prejudice to the Customer's right of withdrawal, we advise the Customer to check the package upon arrival and make any necessary reservations, or even refuse the package, if it appears to have been opened or shows obvious signs of damage. We recommend sending any reservations or complaints to the carrier by registered letter with acknowledgment of receipt within three business days of receiving the Product. The Customer may send a copy of this registered letter with acknowledgment of receipt to Barazol.

Delivery times

All Products are delivered by post within 4 to 7 working days.

If the delivery date is exceeded by more than 30 days, the Customer has the option to cancel the Order for the Product(s), by registered letter with acknowledgment of receipt or by a written notice on another durable medium, if, after having formally requested, using the same methods, that Barazol deliver the Product(s) within a reasonable additional period, Barazol has not complied within that period.

The Order is considered to be resolved on the date of receipt by Barazol of the letter or written notice informing him of this resolution, unless Barazol has performed in the meantime.

In this case, Barazol will reimburse the Customer, as soon as possible and at the latest within thirty (30) days from receipt of the aforementioned formal notice letter, the price of the Product(s) subject to the Order, as well as the delivery costs charged to the Customer.

Delivery price

The delivery fee is charged to the Customer according to the amount specified on the Site at the time of the Order.

Right of withdrawal

In accordance with the provisions of Article L. 221-18 et seq. of the French Consumer Code, the Customer may exercise their right of withdrawal, provided that the nature of the Products purchased does not preclude it. The Customer may decide to withdraw from their Order, without needing to give any reason, within a period of fourteen (14) clear days from the date of receipt of the Product.

The Customer who wishes to exercise his right of withdrawal must inform Barazol no later than the period of fourteen (14) days provided above by sending Barazol the duly completed Withdrawal Form by email or post.

In the event that several Products are sent to the Customer in several separate shipments, making up a single Order, this withdrawal period runs from the date of receipt by the Customer of the last of the Products making up the Order.

As soon as possible after the Client receives the Withdrawal Form, which formalizes the Client's intention to exercise their right of withdrawal, Barazol will acknowledge receipt to the Client by email.

The Customer, without undue delay and at the latest within fourteen (14) days from the communication of his decision to withdraw to Barazol, shall return the Product(s) concerned to Barazol at the postal address specified in the Withdrawal Form and in accordance with the terms and conditions specified in said Withdrawal Form and in the information note attached thereto.

The costs associated with returning the Product(s) subject to the right of withdrawal are the sole responsibility of the Customer.

The exercise of the right of withdrawal must be made subject to the good faith of the Customer who in particular undertakes to return the Product(s) only in perfect condition (not damaged, soiled, unsealed), in their original packaging accompanied by all possible accessories and documentation, which implies in particular that the Product(s) have not been subjected to any use unsuitable for their return.

The returned Product(s) must also be accompanied by the Order invoice so that Barazol can identify the Order and the Customer concerned.

The Customer is liable if the Product arrives in Barazol damaged or in a condition that does not allow its resale or in a depreciated condition resulting from handling other than that necessary to establish its nature and/or characteristics.

In the event that Barazol receives Product(s) subject to the right of withdrawal which do not allow Barazol to provide a refund, Barazol informs the Customer by email and returns the Product(s) concerned.

Under the exercise of the right of withdrawal under the conditions defined in this article, Barazol shall reimburse the Customer for the price of the Product(s) subject to the right of withdrawal, including delivery costs.

The Customer's refund under the right of withdrawal will be made by the same means of payment as that used by the Customer for the acquisition of the Product(s), namely by transfer to his bank account associated with the bank card with which he made the payment, which the Customer accepts without reservation, at the latest within thirty (30) days from the receipt by Barazol of the Product(s) subject to the right of withdrawal.

Legal and contractual guarantees

Barazol is liable for defects in conformity of the Products under the conditions of the Consumer Code and for hidden defects of the Products under the conditions of the Civil Code.

When acting under the legal guarantee of conformity, the Customer:

  • benefits from a period of two (2) years from the delivery of the Product to take action,
  • may choose between repair or replacement of the Product, subject to the cost conditions stipulated by the Consumer Code,
  • is exempt from providing proof of the existence of the non-conformity of the goods during the twenty-four (24) months following delivery of the Product.

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

The Customer may also decide to implement the warranty against hidden defects of the Product as defined in the Civil Code and in this case, he may choose between the termination of the sale or a reduction in the sale price in accordance with the Civil Code.

Personal Data

The Customer's Personal Data is processed in accordance with Barazol's Privacy Policies, accessible from the website footer.

For any information, question, complaint of a technical nature or relating to the Products, or to any Order, the Customer is invited to send their request to the following email address: contact@barazol.com.

Miscellaneous provisions

Correspondence - Proof

Unless otherwise specified in these General Terms and Conditions of Sale, correspondence between Barazol and the Internet user is primarily conducted via email.

Pursuant to Articles 1366 et seq. of the Civil Code, the Internet user acknowledges and accepts that the information delivered by Barazol by email shall be valid between him and Barazol.

Elements such as the time of receipt or transmission, as well as the quality of the data received, shall be considered valid as appearing on the aforementioned media, or as authenticated by Barazol's computerized procedures, unless the Client provides written proof to the contrary.

The scope of proof of the information provided by the Site is that granted to an original in the sense of a written paper document, signed by hand.

Full Terms and Conditions of Sale

These General Terms and Conditions of Sale constitute the entire agreement between Barazol and the Customer regarding their subject matter. The failure of either party to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision.

Partial invalidity

In the event that one or more provisions of these General Terms and Conditions of Sale are considered null, deemed unwritten or declared as such pursuant to a law, regulation or following a decision of a competent court having the authority of res judicata in last resort, the other provisions shall retain their full force and scope and remain fully applicable, unless the invalid provision(s) were of a substantial nature and their disappearance would call into question the contractual balance.

Securities

In case of difficulties of interpretation between one of the headings appearing at the beginning of the clauses of these General Terms and Conditions of Sale and one of the clauses, the headings shall be declared non-existent.

Applicable law and dispute resolution

These General Terms and Conditions of Sale are governed by Estonian law.

In the event of any dispute arising in connection with these General Terms and Conditions of Sale, their interpretation and consequences, or with any supplementary or amending acts thereof, the Customer shall contact Barazol in an attempt to reach an amicable solution. All complaints to Barazol must be submitted in writing.

In the absence of an amicable settlement, the Client may choose:

  • To resort to an amicable mediation solution within a maximum period of one (1) year from the date of the Internet user's written complaint to Barazol by contacting, (i) either a mediator of their choice, (ii) or by using the online dispute resolution system accessible at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, it being specified that the proposed mediation process cannot be a prerequisite to bringing the matter before the competent courts for the Internet user.
  • To bring his claim before the competent Estonian courts.

Appendix 1: Information concerning the exercise of the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days.

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession, if applicable, of the last item.

To exercise your right of withdrawal, you must notify us at Ecomeo OÜ, Lõõtsa tn 2a, 11415 Tallinn, Estonia, by mail or email to contact@barazol.com of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the model withdrawal form, but it is not obligatory.

To ensure that the withdrawal period is respected, you simply need to send your communication regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of retraction

If you withdraw from this contract, we will reimburse all payments received from you, including delivery charges (except for any supplementary costs arising from your choice of a delivery method other than our least expensive standard delivery option), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You must return the goods to us without undue delay and, in any event, no later than fourteen days after you have notified us of your decision to withdraw from this contract. This deadline is met if you return the goods before the fourteen-day period expires.

You will be responsible for the direct costs of returning the item.

Your liability is limited to the depreciation of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods.

Appendix 2: Form for exercising the right of withdrawal
